Introduction
At JahaeRaymakers (“JR”), we use (generative) Artificial Intelligence applications (“AI”) as part of our legal services. By this we mean the application of artificial intelligence whereby new content (such as text or images) is generated on the basis of algorithms, whether or not in response to instructions given by the user.
By integrating AI into our services, we aim to serve our clients more effectively. AI supports our lawyers and our internal processes, but never replaces the legal judgement of our lawyers. They remain ultimately responsible. Furthermore, our use of AI must always be in accordance with the core values of the legal profession. Even when AI is used, our clients must be able to rely on the preservation of our independence, expertise and integrity, as well as the confidentiality of our services.
This policy sets out the principles and safeguards governing the use of AI applications within JR, in compliance with applicable laws and regulations, including the General Data Protection Regulation (GDPR) and the Code of Conduct for Lawyers.
By strictly adhering to this AI policy, JR ensures that technological innovation goes hand in hand with professional legal diligence.
Client consent
JR will only use AI in the provision of our services if and to the extent that the client has given their explicit prior consent.
The foregoing does not apply to the use of AI to conduct (case law) research in public sources. Such (case law) research may also be carried out without explicit prior consent, provided that no confidential client data is shared and the client has not indicated any objection to such use of AI.
Our engagement letter states that, by signing it, a client consents to the use of AI in the provision of our services. A client may at any time indicate that they do not (or no longer) consent to the use of AI in their case.
Permitted use of AI
JR uses AI exclusively as a tool to support legal analysis, text formatting, internal process optimisation and risk assessments. Examples of permitted AI use include structuring information, analysing and summarising (public) sources, and translating documents.
AI never replaces the analysis and legal judgement of a lawyer. Results from AI applications that are relevant to legal services are always reviewed by a lawyer for accuracy, completeness and applicability.
Prohibited use of AI
Entering confidential client data into public AI applications or those not approved by JR is not permitted. AI is not used for independent legal judgement or strategic decision-making. Nor is AI used if the client has not given their consent.
Responsibility and supervision
The use of AI within JR falls under the direct responsibility of the lawyers affiliated with the firm. These lawyers remain personally responsible at all times for the content and quality of all advice, court documents and other documents.
Confidentiality and data protection
JR never processes personal data or other confidential information in open, publicly accessible AI systems. AI is used exclusively within an environment that meets information security requirements. Confidential data is processed only within a closed AI application. JR uses only AI applications for which appropriate contractual and technical safeguards are in place.
Quality assurance and continuous evaluation
JR closely monitors technological and legal developments relating to AI and ensures that staff receive regular training. New staff are briefed on this AI policy. The use of AI within the firm is periodically evaluated and, where necessary, this AI policy is adapted to reflect relevant changes in legislation, technology and/or professional rules.
Final and transitional provisions
This AI policy shall apply with effect from 1 June 2026 to all cases pending with JR.
For natural and legal persons who were already clients of JR on that date and who have not (yet) given explicit consent to the use of AI in the engagement letter, such consent, where required, will be recorded in writing in an appropriate manner by the JR lawyer handling the case.
This AI policy has been drawn up in Dutch and in English. The Dutch language version shall prevail in the event of any discrepancies.
